REGISTERING YOUR ADVANCE HEALTH CARE DIRECTIVE WITH THE STATE OF CALIFORNIA


In July of 2000 when the State of California consolidated its previous advance directive laws to make it easier for individuals to make their preferences regarding health care known through written or oral communication, California Probate Code Section 4800 directed that the Secretary of the State establish a registry system for executed, written advance health care directives.

The registration with the Secretary of the State is not required and choosing not register does not invalidate your Advance Directive. The registry’s purpose is to makes the information in the Directive available upon request to health care providers, public guardian’s offices or to the legal representative of the registrant. The information is available upon a need to know basis.

When registering, a copy of the Directive can be sent to the Registry or information with regard to the intended location of the written advance health care directive. There is a $10.00 fee for the filing for registration of a new directive.

The information needed by the Secretary of State will include social security number, driver’s license number, date of birth and place of birth. This information is needed for identification purposes.

The Secretary of State will provide you with a wallet or purse card indicting that you have registered your directive.

The Registration of Written Advance Health Care Directive is attached and can be printed along with the Secretary of State’s Instruction form. The form must be printed out and sent - it can not be filled out on-line.

Why register?

By registering your directive, health care providers and other authorized individuals may be able to obtain needed information regarding your directive. This could be important if you or your family members are unable to provide this information. For example, suppose you are out-of-town and are admitted in an unconscious state to an emergency room. If you have registered your directive with the California Secretary of State, you are likely to have in your wallet or purse a card indicating that you have registered your directive. By following the instructions on this card, emergency room personnel will be able to obtain information regarding your directive from the California Secretary of State.

What if I amend or revoke my Directive? What if the information on my registration form changes?

Your Advance Health Care Directive is a legal document and should be prepared by your attorney.
